The harasser need not be the victim’s own supervisor; he or she may be a different supervisor, a co-worker or even a non-employee. WHAT CAN YOU DO ABOUT A HOSTILE WORK ENVIRONMENT?
The first step is documenting the offensive conduct. That may mean preserving any offensive emails, letters, photographs, bulletin board postings or other tangible evidence and making a detailed record of any verbal or physical incidents of harassment that you cannot document directly. The next step is to bring the problem to the attention of your employer and asking the person or persons harassing you to stop. If that fails, you can notify your company’s Human Resources department, your harasser’s supervisor or any other relevant authority in your company.
If your employer knows or has reason to know of the hostile work environment and fails to take reasonable steps to prevent and correct it, or retaliates against you for complaining, I can help. I will first file a complaint on your behalf with either the U.S. Equal Employment Opportunity Commission (EEOC) or the Florida Commission on Human Relations (FCHR). If the EEOC issues a “right-to-sue” letter, I can file a claim against your employer in federal court. I can also represent you in a lawsuit against the FCHR if they fail to act on your complaint.
